The Complaint
The complaints in this case arose after the applicant was convicted at court of a stalking offence.
We have reviewed the handling of five complaints, namely that:
An officer falsely prepared a summary of evidence.
The same officer failed to provide statements to the Procurator Fiscal and Defence agent.
The same officer fabricated accusations within a summary of evidence.
The same officer falsely prepared her own statement.
The same officer failed to caution the applicant at the time of his arrest.
Policing bodies decision
Police Scotland applied non-investigation provisions and did not reach a determination on any of the applicant’s complaints.
Our findings
We have found that Police Scotland did not handle any of the applicant’s complaints to a reasonable standard.
We have made a recommendation to address the shortcomings in Police Scotland’s handling of the complaints. In summary, we recommend that Police Scotland conduct further proportionate enquiries, assess all of the available information and issue the applicant with a fresh response to each of his complaints.
Our recommendation should be implemented by Police Scotland within two months of the date of this report.
Outcome
Police Scotland implemented the recommendation made in this case. In doing so they conducted further proportionate enquiries, assessed the information then available to it and provided the applicant with a further response which was detailed and well reasoned.
