The Complaints
The complaints in this case arose after the applicant was arrested at his home following a report from Mrs A. We have reviewed the handling of 4 complaints, namely:
on 18 September 2021 the applicant was not given an opportunity to provide his version of events following police attendance at his address;
on 19 November 2021 the applicant was dissatisfied that police officers informed him that his conduct could amount to the offence of stalking;
on the same date police officers incorrectly told him that his wife making changes online to the registered keeper details of their jointly owned vehicle was a civil matter; and
on 14 January 2022 Police Scotland failed to carry out sufficient enquiries into matters reported by the applicant.
Police Scotland’s Decision
Police Scotland did not uphold any of the applicant’s complaints.
Our Findings
We have found that Police Scotland handled complaints 1, 2 and 4 to a reasonable standard but not so complaint 3. We have made a recommendation to address the shortcomings in Police Scotland’s handing of complaint 3. Our recommendation should be implemented by Police Scotland within two months of the date of this report.
