The Complaints
We have reviewed the handling of three complaints, namely that:
officers made no attempt to speak with the applicant or note a statement from him;
the applicant was not updated regarding the progress of the enquiry or the final outcome of the case; and
insufficient enquiry was undertaken to establish any other witnesses or evidence.
Police Scotland’s Decision
Police Scotland upheld complaints 2 and 3, but did not uphold complaint 1.
Our Findings
We have found that Police Scotland handled complaints 2 and 3 to a reasonable standard, but not so complaint 1.
Consequently we have recommended that Police Scotland should reassess the evidence available on the basis of the points outlined in our report. Police Scotland should then provide the applicant with a fresh response, with reference to the applicable guidance and which fully address the complaint. The fresh response should determine whether the complaint is upheld or not upheld and clearly explain how that conclusion was reached.
Our recommendation should be implemented by Police Scotland within two months of the date of this report.
