The Complaints

The complaints in this case arose after the applicant reported concern to the police that his brother had stolen money from their mother’s bank account. Specifically, the applicant alleged that his brother had unlawfully taken money from their elderly mother during a period of eight years before she passed away.

We have reviewed the handling of one complaint, namely that: 

  1. Police Scotland failed to record or investigate an allegation of criminality which the applicant reported on 26 February 2021.

Our Findings

We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.

Consequently, we have made a recommendation to address the shortcomings in Police Scotland’s handling of the complaint. In summary, we have recommended that Police Scotland re-assess the available information and provide the applicant with a further response which takes account of our observations and which clearly explains whether the complaint is upheld or not upheld.

Our recommendation should be implemented by Police Scotland within two months of this report.
