The Complaints
The complaints in this case arose following the applicants’ reports of fraud to the police. We have reviewed the handling of two complaints, namely that:
- Named tenants committed the crime of fraud and this should have been investigated by the police; and
- Police Scotland failed to provide updates or an outcome to the matter recorded under a particular Crimefile reference number.
Police Scotland’s Decision
Police Scotland did not uphold complaint 1 and did not provide a determination on complaint 2.
Our Findings
We have found that Police Scotland handled complaint 1 to a reasonable standard, but not so complaint 2.
Consequently, we have made a recommendation in relation to complaint 2. In summary, we have recommended that Police Scotland now records complaint 2 and provides the applicant with a further response, which fully addresses the crux of the complaint.
Our recommendation should be completed by Police Scotland within two months of the date of this report.
Outcome
Police Scotland implemented the recommendation made in this case. In doing so, they recorded a new complaint and provided the applicant with a response which acknowledged previous shortcomings in updating him on a relevant crime report. The newly recorded complaint was upheld.
