The Complaints
The complaints in this case arose after the applicant’s partner reported him to the police for behaving in a threatening and abusive manner within her home. Police officers attended, removed the applicant and took him to temporary accommodation where he was to stay overnight. The applicant returned to the property a short while later and his partner reported him to the police as he was again behaving in a threatening and abusive manner towards her. The applicant was thereafter arrested and released from custody on a Police Undertaking to appear at court . The case against the applicant was subsequently discontinued by the Crown Office and Procurator Fiscal Service.
We have reviewed the handling of three complaints, namely that:
- on 4 January 2023, the applicant was wrongfully arrested;
- on the same date, officers failed to notify the applicant’s friend of his arrest in accordance with his rights as an arrested person; and
- on 10 June 2022, officers took no action in relation to a report made by the applicant’s ex-partner about an underage party, despite the applicant’s son being threatened by the group.
Police Scotland's Decision
Police Scotland upheld complaint 2 but did not uphold complaints 1 and 3.
Our Findings
We have found that Police Scotland handled all the applicant’s complaints to a reasonable standard.
