The Complaints
The complaint in this case arose following the applicant’s contact with the police regarding a dispute with the owner of a neighbouring property. We have reviewed the handling of a single complaint, namely that:
- Police Scotland failed to make sufficient enquiries into the applicant’s report that a neighbouring property owner stole bricks from his land.
Police Scotland’s Decision
Police Scotland did not provide a determination on his complaint.
Our Findings
We have found that Police Scotland handled the applicant’s complaint to a reasonable standard.
However, we have also identified a learning point to address a shortcoming in Police Scotland’s letter of response. In summary, we have highlighted the importance of providing a determination to an applicant at the conclusion of the non-investigation process where there is sufficient information available to do so.
Outcome
Police Scotland implemented our learning point in this case by issuing regional force guidance through their monthly bulletin for CHRs.
