The Complaints

The complaints in this case arose when Police Scotland responded to a report about an altercation between the applicant and another party.  

We have reviewed the handling of four complaints, namely that:

  1. on 10 July 2021 a female officer discriminated against the applicant by responding: “ come on, you’re a man and she is a woman” when the applicant requested that the other party was also issued with a warning.

  2. a male officer was uncivil towards the applicant;

  3. officers failed to speak to or take a statement from a witness that the applicant identified;

  4. Police Scotland did not follow the correct procedure, by failing to submit a report to the procurator fiscal, when the applicant contested the Recorded Police Warning.

Police Scotland’s Decision

Police Scotland did not uphold 1, 2 and 3 of the applicant’s complaints but upheld complaint 4.

Our Findings

We have found that Police Scotland handled all of the applicant’s complaints to a reasonable standard.
