The Complaints
The complaints in this case arose from Police Scotland’s response to various complaints made by the applicant between 2020 and 2021.
We have reviewed the handling of three complaints, namely that:
Police Scotland failed to properly deal with numerous complaints made by the applicant for over two years;
Despite requesting that his complaint be investigated by a senior officer, such as the Chief Constable, the applicant’s complaint was investigated by a Superintendent; and
Police Scotland’s Professional Standards Department (PSD) and the Chief Constable do not respond to email correspondence and failed to respond to the 50+ emails which the applicant sent to them.
Police Scotland’s Decision
Police Scotland did not uphold any of the applicant’s complaints.
Our Findings
We have found that Police Scotland handled complaints 1 and 2 to a reasonable standard, but not so complaint 3.
We have made a single recommendation to address the shortcomings identified in complaint 3. In short, we have recommended that Police Scotland undertake further proportionate enquiries and provide the applicant with a further response which addresses the crux of his complaint.
Our recommendation should be implemented by Police Scotland within two months of the date of this report.
