The Complaints
The complaints in this case arose after the applicant was arrested for offences reported by his ex-wife. We have reviewed the handling of three complaints, namely that:
1. Police Scotland conducted an investigation that was racially biased against the applicant, as part of the charge was based on contradictory information provided by the applicant’s ex-wife;
2. an officer did not carry out a fair investigation as she advised she would be attending the applicant’s address for a chat, but then arrested him without letting him speak, appearing to have decided that the applicant was being charged before being interviewed; and
3. the applicant is dissatisfied that bail conditions were imposed which prohibited him from contacting his children, despite there being an interim court order in place which allowed him contact.
Police Scotland's Decision
Police Scotland did not uphold any of the applicant’s complaints.
Our Findings
We have found that Police Scotland handled all of the applicant’s complaints to a reasonable standard.
However, we have identified a learning point in connection with the administration of the complaints.
Our learning point should be implemented by Police Scotland within two months of the date of this report.
Outcome
Police Scotland implemented the learning point in this case. In doing so, the learning point was appropriately disseminated by PSD and accepted by the Inspector who wrote the final response letter.
