The Complaints

The complaints in this case arose from the police interaction with the applicant over a period of few years regarding a dispute between the applicant and a housing developer and excessive noise from neighbours.

We have reviewed the handling of two complaints, namely:

  1. on 21 September 2021, officers attended at the applicant’s home address, lied to him and did not allow him to finish his sentences; and
  2. that over a period of time, covering 3 years, the applicant reported several incidents to the police which were not treated seriously, causing the applicant to be unhappy with the outcome. 

Police Scotland’s Decision

Police Scotland did not uphold the applicant’s complaints.

Our Findings

We have found that Police Scotland handled complaint 1 to a reasonable standard, but not so complaint 2.

We have made a recommendation to address the shortcomings in Police Scotland’s handling of complaints 2.  

We recommend that Police Scotland should provide the applicant with a further response, which addresses the observations made in our report. Specifically, the further response should: refer to the part of the complaint concerning the complaints about excessive noise and the use of hot tubs by the applicant’s neighbours; and clearly state whether the complaint is upheld or not upheld, and the reasoning behind the determination reached.

Our recommendations should be implemented by Police Scotland within two months of the date of this report.
