The Complaints
The complaints in this case arose following the applicant being stopped and arrested in the public street following which he was conveyed to a police station where he was charged with a contravention of section 38 Criminal Justice and Licencing Scotland Act 2010 in relation to a neighbourhood dispute. We have reviewed the handling of six complaints, namely that:
- On 12 June 2021 the applicant was arrested in a public street and taken to a Police Station at which time his wife and daughters were left at that location and had to walk home;
- On 12 June 2021 the officers who arrested the applicant were rude and aggressive towards him;
- On 12 June 2021 the officers who arrested the applicant threatened that he would be deported from the UK;
- On 12 June 2021, police officers did not listen to the applicant when he told them about his neighbour planning to break into his house that evening;
- On 12 June 2021, police officers seized the applicant’s mobile phone and accessed data on it without his permission;
- The applicant was not provided with a solicitor when he requested access to one at the police station; and
- The police officers who arrested the applicant were racist towards him because he is from a foreign country.
Police Scotland’s Decision
Police Scotland did not uphold any of the applicant’s complaints.
Our Findings
We have found that Police Scotland handled all of the applicant’s complaints to a reasonable standard.
