The Complaints

The complaints in this case arose as a result of the applicant attempting to report a crime to Police Scotland, which he believed had been committed by his local council. We have reviewed the handling of a single complaint, namely that:

Police Scotland did not investigate the applicant’s report of a crime and dismissed his report without appropriate evidence.

Policing bodies decision

Police Scotland did not uphold the applicant’s complaint.

Our findings

We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.

Consequently, we have made a recommendation to address the shortcomings in Police Scotland’s handling of the complaint. In summary, we have recommended that Police Scotland carry out further enquiry and thereafter provide the applicant with a further response.

Our recommendation should be implemented by Police Scotland within two months of the date of this report.

Outcome

Police Scotland implemented the recommendation made in this case. In doing so, they carried out further enquiry with the officers involved and provided the applicant with a further response. The further response assessed the evidence available and explained that the complaint remains not upheld.
