FOISA Response No. 859 - How to complain about police procedures

Where relevant, we publish our responses to Freedom of Information requests under the Freedom of Information (Scotland) Act 2002 (FOISA).

This response addressed the following query:

  • “how would I go about obtaining information about a police operation to build a case for a complaint about police procedures and non compliance with regulations.”

You may be able to obtain information about a police operation from the relevant police body. You can request information under FOISA for general information or data protection legislation for your own personal information. Information on how to do this will be available on the website of the police body.

For example, details on how to submit a FOISA request to Police Scotland can be found at https://www.scotland.police.uk/access-to-information/freedom-of-information/.

If you are requesting your own personal information, details on how to submit a Subject Access Request under the UK General Data Protection Regulation and Data Protection Act 2018 can be found at https://www.scotland.police.uk/access-to-information/data-protection/subject-access-requests/.

Complaints about police procedures and non compliance with regulations can be submitted to the Professional Standards Department (PSD) of the relevant police body. In Scotland they can be contacted at:

You can also submit a complaint at your local police station, by calling 101 or using the online form available at https://www.scotland.police.uk/about-us/how-we-do-it/complaints/make-a-formal-complaint/. PSD would then investigate your complaint.
