FOISA Response No. 843 - retention schedule

Where relevant, we publish our responses to Freedom of Information requests under the Freedom of Information (Scotland) Act 2002 (FOISA).

This response addressed the following query:

  • “How long do you hold evidence and records that complainers send you before you destroy them, six days, six months or what is the legislation for keeping records”

Under Section 17 of FOISA, I can confirm that we hold information which fits within the scope of your request. There is no legislation that dictates how long the PIRC keep case related records. Article 5 of the UK General Data Protection Regulation (UK GDPR) states that personal data is stored “no longer than is necessary for the purposes for which the personal data are processed.”

The PIRC Records Management Policy takes this requirement into account and outlines our procedures for managing case related and non-case related information. It also includes the retention periods for Complaint Handling Reviews files, as requested. This policy is available to view at:
