FOISA Response No. 780 - complaint timescale

28 Oct 2022
Content

Where relevant, we publish our responses to Freedom of Information requests under the Freedom of Information (Scotland) Act 2002 (FOISA).

This response addressed the following query:

  • “please advise me what your timelines are. You should consider this a FOI request for all documentation regarding your Complaints handling process”

The PIRC has considered this as a request under the Freedom of Information (Scotland) Act 2002 (“FOISA”). An application for information held by public authorities under section 1 of FOISA requires that a public authority release all information held, subject to any applicable exemptions.

We aim to complete the review process as quickly as possible. However, as each case is different the time taken to review it will vary depending on factors such as the complexity of the complaint or the volume of information we receive from you and the policing body involved. We aim to complete at least 80% of our cases within 4 months from receipt of the application. This timescale does not include any period of time that we are awaiting information to be provided by the police or the applicants.
