The Complaints

The complaints in this case arose after the applicant reported her ex-husband to the police for breaching a non-harassment order. Officers attended at the applicant’s address and noted a statement from her. Thereafter, officers discussed the applicant’s report with the duty sergeant, who all agreed that the applicant’s ex-husband’s conduct did not amount to a breach of the order. The police took no further action. We have reviewed the handling of three complaints, namely that: 

  1. Officers carried out an insufficient investigation into the applicant’s report that a non-harassment order had been breached.

  2. Officers provided incorrect information about the applicant’s ex-husband being subject to an electronic monitoring device on his release from court, and 

  3. The applicant is dissatisfied with the length of time it has taken the Professional Standards Department to deal with her complaints.

Police Scotland's Decision

Police Scotland upheld all three of the applicant’s complaints.

Our Findings

We have found that Police Scotland handled complaints 1 and 2 to a reasonable standard but not so complaint 3. 

We have identified three learning points relative to Police Scotland’s administration of the complaints.

Our learning points should be implemented by Police Scotland within two months of the date of this report.
