The Complaints
The complaint in this case arose after the applicant’s vehicle was stopped by police officers:
the applicant was grabbed by the arm and restrained as he went to produce the documents that the police requested;
an officer pinned the applicant against his vehicle and
the applicant heard an officer say “see you soon” which he perceived as a threat.
Police Scotland's Decision
Police Scotland did not uphold either of the applicant’s complaints.
Our Findings
We have found that Police Scotland did not handle any of the complaints to a reasonable standard.
We have made two recommendations and identified a learning point to address a shortcoming in Police Scotland’s handling of the complaints. In summary, we recommended that Police Scotland carry out further enquiries, re-assess the available information and issue the applicant with a further response which clearly explains the rationale for the determination reached. Our learning point relates to compliance with the CAP SOP and our Statutory Guidance.
Our recommendations and learning point should be implemented by Police Scotland within two months of the date of this report.
