The Complaints
The complaints in this case arose after the applicant was arrested in relation to a domestic incident at his home address. The applicant was interviewed and thereafter remanded in custody overnight by Police Scotland.
We have reviewed the handling of two complaints, namely that:
- the applicant was treated unfairly by the police because they believed he had previous convictions; and
- the police sent incorrect information to the Crown Office and Procurator Fiscal Service (COPFS) in relation to the applicant’s previous offending history and pending cases.

Our Findings
We found that Police Scotland did not handle either of the applicant’s complaints to a reasonable standard
Consequently, we made two recommendations and identified a learning point to address the shortcomings in Police Scotland’s handling of the complaints. In summary, we recommend that Police Scotland conduct further necessary and proportionate enquiries, re-assess the available information and issue the applicant with a further response which fully addresses all aspects of his complaints. Our learning point is in relation to the sufficiency of the complaint enquiry.
