The Complaint

The complaint in this case arose after the police forced entry into the applicant’s address. We have reviewed the handling of a single complaint, namely that:

  • On 21 July 2022, officers failed to re-secure the applicant’s property after forcing entry.  

Police Scotland’s Decision

Police Scotland did not uphold the applicant’s complaint.  

Our Findings

We have found that Police Scotland handled the applicant’s complaint to a reasonable standard.

However, we have issued two learning points that have been identified in Police Scotland’s administration of the complaint. In summary, we have highlighted the importance of identifying officers in the complaint response letter. We have also highlighted learning around the use of the non-investigation provision as per the PIRC statutory guidance and Complaints About the Police Standard Operating Procedure (“Complaints SOP”).  

Our learning points should be implemented by Police Scotland within two months of the date on this report.
