The Complaints
The complaints in this case arose after the police visited the applicant’s home in relation to an alleged road traffic incident involving a vehicle registered in her name. The complaints were about the procedural actions of two police officers during this visit, and the delay in conducting the complaint enquiry.
We have reviewed the handling of three complaints, namely that:
- Police officers stated that they had carried out a Section 172 Road Traffic Act 1988 procedure when they did not;
- Police officers stated that they cautioned and charged the applicant with a Section 170 Road Traffic Act 1988 when she said she was not driving; and
- The length of time taken to deal with the complaint.
Police Scotland's Decision
Police Scotland did not uphold any of the applicant’s complaints.
Our Decision
We have found that Police Scotland handled complaints 1 and 3 to a reasonable standard, but not so complaint 2.
We have not made any recommendation in respect of the shortcomings we identified in the handling of complaint 2. However, we have made a learning point for Police Scotland. This relates to responding to complaints about delays.
Our learning point should be completed by Police Scotland within two months of the date of this report.
