The Complaints

The complaints in this case arose after the applicant reported concern to Police Scotland that his daughter’s ex-partner, a serving police officer, had been abusing his position by having welfare checks carried out on their children in order to harass his daughter. 

We have reviewed the handling of two complaints, namely that: 

  1. The conduct unit did not contact the applicant to discuss his concerns, as had been indicated would happen; and 

  2. The decision to carry out a safe and well check, given all of the circumstances, was flawed.

Police Scotland's Decision

Police Scotland did not uphold either of the applicant’s complaints.

Our Findings

We have found that Police Scotland did not handle either of the applicant’s complaints to a reasonable standard. 

Consequently, we have made two recommendations to address the shortcomings in Police Scotland’s handling of the complaints. In summary, we have recommended that Police Scotland conduct any further necessary enquiries and, thereafter, reassess the available information in light of our observations and issue the applicant with a well-reasoned further response which clearly explains whether the complaints are upheld or not upheld.

Our recommendations should be implemented by Police Scotland within two months of the date of this report.
