The Complaint
The complaint in this case arose after the applicant reported concern to Police Scotland that his records had been inappropriately accessed by serving officers.
We have reviewed the handling of one complaint, namely that:
- There has been inappropriate access to records by police officers affiliated with a Named Area.
Police Scotland's Decision
Police Scotland did not provide a determination for the applicant’s complaint.
Our Findings
We have found that Police Scotland did not handle the applicant’s complaint to a reasonable standard.
Consequently, we have made one recommendation and identified two learning points to address the shortcomings in Police Scotland’s handling of the complaint. In summary, we have recommended that Police Scotland conduct any further proportionate enquiries and, thereafter, reassess the available information in light of our observations and issue the applicant with a well-reasoned further response which clearly explains whether the complaint is upheld or not upheld.
Our learning points relate to the use of non-investigation provisions and communicating a complaint determination to the applicant in the final response letter.
Our recommendation and learning points should be implemented by Police Scotland within two months of the date of this report.
