The Complaints
The complaints in this case arose after the applicant reported an allegation of theft to Police Scotland. We have reviewed the handling of three complaints, namely that:
- Police Scotland failed to review potential CCTV
- Police Scotland did not provide the applicant with an explanation as to why his case was closed and
- when the police investigation was re-opened, the matter was re-investigated by the officers who were involved in the initial investigation
Police Scotland’s Decision
Police Scotland did not uphold any of the applicant’s complaints.
Our Findings
We have found that Police Scotland handled complaints 2 and 3 to a reasonable standard, but not so complaint 1.
We have made a recommendation to address a shortcoming in Police Scotland’s handling of complaints 1 and 2 . Specifically we recommend Police Scotland records complaints 1 and 2 as separate Heads of Complaint.
Our recommendation should be implemented by Police Scotland within two months of the date of this report.
