The Complaints
The complaints in this case arose after the applicant was arrested in relation to a domestic incident at his home address.
- the applicant did not receive access to legal advice when requested; and
- the applicant believes he was detained overnight and held in custody for requesting a lawyer for advice
Police Scotland's Decision
Police Scotland did not uphold either of the applicant’s complaints.
Our Findings
We have found that Police Scotland did not handle either of the complaints to a reasonable standard
We have made a recommendation and identified a learning point to address a shortcoming in Police Scotland’s handling of the complaints. In summary we have recommended that Police Scotland conduct all necessary further enquiries, re-assess the available information and taking account of our observations, issue the applicant with a further response which provides sufficient explanation to support the determination reached. Our Learning Point is in relation to the Complaint about the Police Standard Operating Procedure.
Our learning points should be implemented by Police Scotland within two months of the date of this report.
