The Review team has published nine Complaint Handling Review (CHR) reports this week.

In five of the reports containing a total of 9 complaints made, we concluded that they were all handled to a reasonable standard by Police Scotland.

The majority of complaints made in three other reports were also reasonably handled.

Our role is to review the way in which policing bodies handle complaints made about them. It is not to investigate the circumstances which led to the complaint or uphold allegations made. When carrying out a Complaint Handling Review (CHR) we consider a number of factors, including whether police carried out sufficient enquiries; their response was supported by the material information available and whether the police response was adequately reasoned.

In PIRC/00548/18, our Review Team examined three complaints in relation to the applicant being charged with a road traffic offence. We supported Police Scotland’s decision not to uphold two of the complaints, but issued a recommendation to re-assess the handling of the other complaint.

For PIRC/00168/17, a total of 11 complaints were made following the applicant’s arrest and detention in police custody. We found that 10 of the complaints were handled to a reasonable standard by Police Scotland.

In PIRC/00567/18 & 00033/19 & 00088/19, the 10 complaints in this case arose following the applicant’s contact with the police in relation to what he described as a vendetta against him by individuals in his neighbourhood. Our report concluded that seven of the complaints were handled to a reasonable standard.

We made one recommendation to address the shortcomings in Police Scotland’s handling of the other three complaints. Further enquiries should be carried out for one of these complaints and a further response should then be sent to the applicant.

For PIRC/00072/19, complaints were made about the police after the applicant’s wife telephoned 999 and officers attended at their home to check if the woman was ok.

We found that only one of the six complaints was handled reasonably by Police Scotland.

Three recommendations and a learning point were issued to address issues identified in the handling of the complaints.
